Top among immigrant resources is the i-751 form which is formally called “Petition to Remove the Conditions of Residence”.  This form ensures that passport renewal can be delayed through a US Green Card extension based on marriage.

To file this form you need to go to the official website for the USCIS and find the link there.  They will accept old editions of the form, but for safety you should try to get the most current one.  Many immigrant resources websites also have it but they might not have the January 2011, edition.  To use this form to avoid a passport renewal in the event that your conditional US Green Card expires you need to have gained status since your last interview that makes you eligible for a 10 year renewable green card through the process of marriage to a legal citizen of the United States.

The form itself is three pages.  The instructions are a separate five page download. It is important that you read the instructions and understand exactly what is being asked for. Not only is it important to send the packet to the correct location, but it is vital that the form be filled out correctly. Placing the wrong information or leaving out something that might help your case can extend the review process and make it difficult to gain approval.

When you get to the point of your provisional green card expiration, there is a ninety day window for you to file this form.  It must not be sent in before this period, and waiting too long can wind you in an automatic eviction from the country.  You need to be aware then when  your status is about to expire and have the form ready to go when that window opens.

You should include information not just on yourself, but on any children that have been born during the relationship.  Each child requires an extra biometrics fee, but this is much cheaper when done as a family then doing it individually. Plus including the children can strengthen your claim of marriage and help you prove you should have the conditions lifted on your residency.

The location that the packet needs to be sent to depends on the state in which you live. Residents of  Alaska, American Samoa, Arizona, California, Colorado, Guam, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin, and Wyoming need to file their i-751 petitions with the California Service Center.  All others must file with the Vermont Service Center.

Providing proof of marriage is not hard, but sending in a marriage certificate is not enough.  Remember  to include utility bills, jointly held accounts, loans, or property documents, vacations (include photos and recipts), and child related documentation. Testimonials can  also be sent in, and may help your case if you are low on other forms for evidence.  Remember, it is this proof that counts the most to successfully gaining a lift on your residency restrictions.
